Terms and Conditions of Service

Welcome to Corp-Digital53 ("Digital53", "we", "our", or "us"). By accessing our website, applications, Cloud ERP, POS, CRM, and Managed IT services, you agree to comply with and be bound by the following Terms of Service.

1. Services Scope

Digital53 provides enterprise resource planning (ERP), point of sale (POS), human resources management (HRM), document management (DMS), custom software development, cloud hosting, and managed IT infrastructure solutions for commercial enterprises operating in Kuwait, the GCC, Europe, and Africa.

2. Service Level Agreements & Uptime

Our cloud-hosted applications and managed systems are engineered for high availability (99.9% target uptime), backed by automated failover, regular offsite backups, and disaster recovery planning protocols. Planned maintenance windows are communicated to administrative points of contact in advance.

3. Regional Labor & Regulatory Compliance

Tools and calculations provided by Digital53, including the Kuwait End-of-Service Benefit (EOSB) Calculator, are built in accordance with governing statutes such as Kuwait Private Sector Labor Law No. 6/2010. While engineered for statutory precision, client organizations remain responsible for reviewing legal calculations against their specific employment contracts and company bylaws.

4. Data Ownership & Confidentiality

Clients retain exclusive ownership of all proprietary data, commercial records, employee records, and transactional information entered into our systems. Digital53 implements strict confidentiality safeguards, encrypted transit (TLS 1.3), and hardened access control mechanisms.

5. Intellectual Property

All proprietary software frameworks, source code, user interfaces, branding, and documentation provided by Corp-Digital53 remain the intellectual property of Digital Edge Solutions. Clients receive a licensed right of use pursuant to their active service subscription or master agreement.

6. Governing Law & Jurisdiction

These terms are governed by and construed in accordance with the laws of the State of Kuwait. Any disputes arising under these terms shall be subject to the competent commercial courts of Kuwait City.
